Terms And Conditions
The terms and conditions contained herein shall be binding on each and every customer and potential customer of GreenForGold™ and shall inure to the benefit of GreenForGold™ and GreenForGold™s successors and assigns. By requesting and/or submitting a package customer understands, agrees with, and is legally bound to the following terms.
Requirements For Use
Every customer must be at least eighteen (18) years of age in order to conduct business with GreenForGold™. In addition, every customer of GreenForGold™ must be the actual owner of any and all property sold or attempted to be sold to GreenForGold™, and every customer must be acting on his or her own behalf and not as the agent or representative of another person. GreenForGold™ may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.
Guarantee Against Loss
GreenForGold™ will guarrantee against loss of the total contents properly shipped to GreenForGold™ in the Shipping Packet in accordance with the instructions and procedures established by GreenForGold™ and subject to the terms and conditions displayed at GreenForGold™.com. GreenForGold™ offers two types of insurance coverage. Under Base Rate coverage, GreenForGold™'s liability will be limited to one-third (1/3) of the value of the total content, or Two Hundred Fifty($250.00) Dollars, whichever is less. If there is no original sales slip or appraisal, GreenForGold™s liability will be limited to One Hundred($100.00) Dollars. If in the event the client had received approval and coverage for a value exceeding Base Rate, by request, GreenForGold™ shall be liable for this declared value.This Guarantee shall apply only to merchandise shipped in the Shipping Packet packaging supplied by GreenForGold™. GreenForGold™ reserves the right, in its sole discretion, to reject delivery of any mail, envelope or package which appears to be damaged, opened, or tampered with and any such mail, envelope or package will be returned by the post office to the customer. GreenForGold™ shall have no liability to any customer for any such attempted delivery or return of any such items.
Waiting Period For A Claim
A customer who wishes to submit a claim to GreenForGold™ must wait at least sixty (60) days before submitting a claim form and wait no later than 3 months from date of loss. In order to be processed, the claim form must be fully and accurately completed, signed and mailed to GreenForGold™ in accordance with the claim form instructions. The customer must submit any and all supporting documentation with the completed and signed claim form. Failure to properly complete, sign and/or mail the claim form will result in the denial of the claim by GreenForGold™.
Limitation Of Liability
This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customers successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customers transaction with GreenForGold™. In no event shall GreenForGold™ be liable to any third party, including any insurance carrier. GreenForGold™ shall not be liable for any subrogation claim brought by customers insurance carrier, and, by submitting an item to GreenForGold™, customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier. The customer/seller expressly acknowledges and agrees that if there is no appraisal which was issued prior to the contents being submitted to GreenForGold™, GreenForGold™'s liquidated value shall be conclusive and binding and further, that in no event shall GreenForGold™'s Liability exceed One Hundred ($100.00) Dollars. GreenForGold™ shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above. By submitting the item, customer explicitly and expressly accepts this limitation of liability.
Use Of Online System
The GreenForGold™ online system is available for use by any of GreenForGold™'s existing or potential clients. The online system has been tested and has been shown to be secure. The default system does not transmit any volatile or personally incriminating data. All users of the system assume fully liability for the data that is entered and transmitted. GreenForGold™ shall not be held liable for loss, theft, or accidental destruction of data. GreenForGold™ shall not be liable for
GreenForGold™ will not be held liable nor responsible for any misuse of the online system. GreenForGold™ reserves the right to seek legal prosecution against any entity that has illustrated any sign of misuse or malicious use of the online system, including and not limited to misrepresentation, impersonation, computer hacking, or verbal manipulation. GreenForGold™ shall not be held liable for password theft, and impersonation known as Account Hijacking.
Gold Chart Disclaimer of Liability
GreenForGold™ shall not be responsible for the contents of the gold chart data appearing on its website. These charts are prepared and provided by third parties other than GreenForGold™, and GreenForGold™ includes such charts only for general information to its customers. GreenForGold™ shall not be held liable to anyone who relies on the information contained therein. Customers offering merchandise for sale to GreenForGold™ understand and expressly accept and agree that they will be offered a fair market value for such items. In addition, GreenForGold™ shall at its discretion differentiate between the properties of refined and pre-refined bullion, coins, and bars. Upon its maximum payout, GreenForGold™ will issue no more than 94% of daily 2nd London Fix spot market price per distinct karat ounce, unless 55 ounces or more of a distinct karat is provided. A minimum amount of 3 ounces of a distinct karat is required in order for a 96% payout. Maximum payout on Platinum is 60% of spot metal price.
Evaluations
Evaluations are performed within 24 hours of receiving the shipment at our facility. Please note that if a tracking number states that the package has been delivered, it may not be the case, as we must pick up the package from a specific drop off location. Evaluations on specialized items such as silver and platinum may take up to 5 business days as special methods and personnel are required.
Offers
Any customer or prospective seller may request GreenForGold™ to provide a telephone or online quote for his or her items after such items have arrived at GreenForGold™s processing facility. Verbal offers may, at the discretion of GreenForGold™, be recorded.
Once an offer is accepted and approved, the transaction is thereafter rendered finalized and the merchandise will no longer be available for return to the client. All material will be destroyed 14 days after transactions close.
Payments
Upon a verbal or online acceptance by the customer of the telephone or GreenForGold™'s online system, payment will be issued by GreenForGold™ within twenty four (24) hours of such acceptance. Customer understands that a money order may be substituted for a check or Paypal depending on availability. All Payments shall be issued to the Name and Address that is on file with GreenForGold™. Additionally, this applies to Paypal payments which shall be directed to the Paypal Email address on file.
Returns
GreenForGold™ will not be responsible for return postage on items that yield no value to us. Customer must pay all accompanying fees involved in this type of return. GreenForGold™ will not be held liable for Insurance coverage on return shipments. The same applies to customers who submit any amount of silver over and not limited to an ounce. Client is responsible for all Insurance charges on return shipments and must adhere to selected insurance methods established by GreenForGold™. If in the event a return is requested on item(s) initially shipped to GreenForGold™ using a Special Request Shipping Method(UPS, FEDEX etc.), at GreenForGold™'s cost, customer is responsible and liable to reimburse GreenForGold™ for these fees. GreenForGold™ provides Non-Commitment & Complimentary USPS shipping method options. Although, if in the event a Special Request Shipment is made, it is understood by GreenForGold™ that the prospective client is serious about completing a quick & secure transaction. GreenForGold™ will then make special arrangements custom tailored to the individual's needs and wants, therefore if client fails to complete the transaction, GreenForGold™ shall and will not be held liable for any third party shipment fees, and will act accordingly within its power to satisfy the needs of a client and to positively complete the transaction and redemption of the material. The same applies to any basic USPS shipment which was rendered in an Insurance value of $3,000 or more.
Return Insurance Liabilities
Customers offering merchandise for sale to GreenForGold™ understand and expressly accept and agree that they will be offered the fair market wholesale value for such items. In the event that an item is returned to a customer, GreenForGold™ will pay postage for shipping, but will under no condition insure the package upon return shipment. Customer is fully responsible for Insurance on any returning package of any value under any circumstance. An opportunity will be given to every customer to insure the returning parcel. GreenForGold™ shall, in its sole discretion, choose the return carrier, insurance and receipt verification method for each transaction. If in the event customer rejects the option to insure parcel he/she must agree to complete our Insurance Waiver Form and return it to us within the given time frame. If in the event an designated price is locked in via verbal communication and and there is a failure to complete the transaction, under any circumstance, the client is liable to pay a cancellation fee. Please understand that once a price is locked in, GreenForGold™ is held liable for transaction fees with the bank. If in the event a customer rejects payment on Platinum and or Silver the customer is liable to pay a non-negotiable flat rate assay fee, of $45.00. Please understand that we do everything in our ability to meet the needs of our customers, and if they fail to complete a mutually beneficial transaction, they are liable to compensate us for the time, energy, and material used during the evaluation process.
Transaction Expiration and Abandonment
If in the event that an available price quote and evaluation summary is not accepted nor declined within 3 Business day starting from the Evaluation Date/Revaluation Date, the transaction shall be finalized and the merchandise will no longer be available for return to the client.
If in the event a clients item(s) are deemed valueless or too minimal to purchase(less than 4 grams of precious metal) the client is responsible to submit a payment to GreenForGold™ for the return of the material. If in the event that a payment is not received within 8 Business day starting from the Evaluation Date, the transaction shall be finalized and the merchandise will no longer be available for return to the client.
If in the event that a package is to be returned to a client due to dissatisfaction with service and/or the results the client must submit the payment for return insurance or Waiver of Liability. If one of the two mentioned, is not received within 8 business days and starting from the Date of Final Decline the transaction shall be finalized and the merchandise will no longer be available for return to the client. If in the event a package arrives at GreenForGold™'s facility and is unable to be identified the package will become property of GreenForGold™ after 30 business day post receipt date.
Choice of Law, Waiver, and Claims
This Agreement shall be governed by the laws of the State of New York without regard to its conflict of law provisions. GreenForGold™'s failure to exercise or enforce any right or provision of the Agreement will not be deemed to be a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services must be filed within one (1) year after such claim or cause of action arose or be forever barred. Any such claim or cause of action must be filed in New York. GreenForGold™ shall be entitled to reimbursement for any and all costs incurred by it in defending any civil action filed or attempted to be filed in any jurisdiction outside of New York, including but not limited to, attorneys fees incurred by GreenForGold™.
